DECISION on the Unification of Departments of Industry, Commerce, Tourism to Thai Nguyen Administration of Industry and Commerce THAI NGUYEN PEOPLES COMMITTEE

Pursuant to Law on Organization of Peoples Council and Peoples Committee year 2003
Pursuant to the Decree No. 13/2008/ NĐ-CP dated 04/02/2008 of the Government regulated on establishment of professional agencies belonged to Peoples Committees of the provinces and cities under the Central Government;

Pursuant to the manual document No. 426/BNV-TCBC dated 18/02/2008 of Ministry of Interior on implementation of the Decree No. 13, 14 dated 04/02/2008 of the Government regulated on establishment of professional agencies belonged to Peoples Committees of the provinces and districts;

Pursuant to the Circular No. 362-TB/TU dated 10/3/2008 of Thai Nguyen Province on Conclusion of Provincial Standing Committee of the Party to the content and preparation for the 2nd Meeting – Provinces Peoples Council (Term XI);

Follow to the agreement of Permanent Members of Provinces Peoples Council at the document No. 27/HĐND-TH dated 26/3/2008 on the Implementation of Decree No. 13/2008/NĐ-CP and Decree No. 14/2008/NĐ-CP;

Based on the proposal of Director of Department of Interior, at the Statement No. 598/TTr-SNV dated 26/3/2008;

DECISION
Article 1. Unify Departments of Industry, Commerce, Tourism to Thai Nguyen Administration of Industry and Commerce; hand on the function and organization in the field of tourism to Department of Culture, Sport and Tourism from 01/4/2008. The unification; function, responsibility handover must be completed before 30/4/2008. The Thai Nguyen Administration of Industry and Commerce will officially operate from 01/5/2008.

Details: Function and organization in the field of tourism will be handed to Department of Culture, Sport and Tourism followings:
+ Tourism Management Division
+ Nui Coc Lake Management Board
+ Personnel who are in charge of Tourist activities

Head office of Administration of Industry and Commerce: Located at No. 4, Cach Mang Thang Tam Road, Phan Dinh Phung Ward, Thai Nguyen City, Thai Nguyen Province.


Article 2. Organization chart, personnel:

1.1. Leaders: Director and not over 03 Deputy Directors

1.2. Divisions belong to the Administration:
+ Office
+ Inspectorate
+ Planning and Economy Division
+ Import-Export Management International Economic Integration Division
+ Domestic Commercial Management Division
+ Electricity Management Division
+ Technique – Technology Division

Each division has Manager and 01 or 02 Assistant Manager(s) as regulations

1.3. Units belong to the Administration:

+ Market Management Branch
+ Trade and Tourism Promotion Center
+ Industrial Encouragement and Industrial Development Consultancy Center
2. Personnel: Personnel of the Administration will be assigned by Provinces Peoples Committee as the annual personnel plan of province.


Article 3. Function and responsibility of the Administration, before having official Manual Circular of Inter-Ministry, will be followed the regulations on Joint Circular No. 02/2003/TTLT - BCN - BNV dated 29/10/2003 of Ministry of Interior and Ministry of Industry to guide on function, responsibility, authority and professional organization chart to help Peoples Committee to manage industrial activities in the location; Joint Circular No. 08/2005/TTLT/BTM - BNV dated 08/04/2005 of Ministry of Interior and Ministry of Trade Industry to guide on function, responsibility, authority and professional organization chart to help Peoples Committee to manage trading activities in the location.


Article 4. Director of Administration of Industry and Commerce cooperates with Department of Interior to check the list of moved cadres, civil servants, office holders, personnel to consider under the authority.
Director of Department of Finance leads, guides, cooperates with related departments to make financial audit, inventory of assets, technical facilities …; make plan, solutions submitted to Province’s Peoples Committee for approval

Article 5. Office Manager of Provinces Peoples Committee; Director of Department of Interior; Director of Department of Finance; Director of Department of Planning and Investment; Director of Department of Industry and Commerce; Director of Department of Culture, Sport and Tourism; Chairman of People’s Committee of districts, cities, communes and leaders of related departments, branches, units implement this Decision./.
